Terms & Conditions – HSD Assist
1. Purpose
These Terms & Conditions govern the administrative assistance services provided by HSD Assist to private individuals and professionals.
HSD Assist primarily supports expatriates, airline crew members (Pilots & Cabin Crew), and individuals requiring assistance with French administrative procedures.
Services may include, but are not limited to:
- French income tax return assistance
- Administrative support (CAF, CPAM, social security, residency-related procedures, etc.)
- Relocation and settlement assistance in France
- Document preparation and follow-up
- Guidance regarding airline crew real-expense calculations (“frais réels”)
2. Nature of Services
HSD Assist provides administrative assistance only.
HSD Assist is not a law firm, tax law practice, accounting firm, or certified chartered accountant (“Expert-Comptable”).
No legal, tax, accounting, or financial advice is provided.
All services are performed solely based on the information and documents provided by the client.
The client remains entirely responsible for:
- the accuracy of the information transmitted,
- the completeness of the documents provided,
- and the final validation of any declaration or administrative document submitted.
3. Tax Return Assistance
Tax returns prepared by HSD Assist are based exclusively on the documents and information transmitted by the client.
HSD Assist may assist with:
- identifying potentially deductible expenses,
- applying standard tax provisions,
- administrative completion of forms,
- and explaining publicly available procedures.
However:
- no tax result, refund, reduction, or outcome is guaranteed,
- tax authorities remain solely competent regarding validation and assessment,
- and the client remains legally responsible for the declaration submitted under their name.
4. Airline Crew Specific Assistance
For Pilots and Cabin Crew, HSD Assist may assist in calculating professional expenses (“frais réels”), including:
- professional meal allowances,
- overnight expenses,
- mileage deductions,
- professional insurance,
- union fees,
- and other potentially deductible professional costs.
These calculations are performed using information provided by the client, airline attestations, schedules/rosters, and publicly available tax documentation or scales.
HSD Assist does not guarantee the acceptance of these deductions by the French tax authorities.
5. Client Obligations
The client undertakes to provide accurate, complete, and truthful information.
The client remains responsible for checking all prepared documents, verifying all amounts, and validating all declarations before submission.
6. Submission of Documents
Documents may be transmitted electronically, including by email, WhatsApp, cloud platforms, or electronic signature systems.
The client acknowledges the risks associated with electronic communication and accepts these means of transmission.
7. Authorization to Submit on Behalf of the Client
When expressly authorized by the client in writing (including by email or electronic message), HSD Assist may assist with the submission of administrative or tax documents on the client’s behalf.
Such authorization does not transfer legal responsibility from the client to HSD Assist.
8. Fees & Payment Terms
Fees are communicated through a quotation (“quote”) prior to the beginning of services.
Payment is due upon acceptance of the quotation and before commencement of services, unless otherwise agreed in writing.
Additional services or requests may be subject to supplementary invoicing.
9. Success Fee (Tax Refund Related)
Certain tax assistance services may include a progressive success fee applicable only in the event of an actual tax refund issued by the French tax authorities.
- 10% on the portion of the refund up to €1,000
- 8% on the portion between €1,001 and €3,000
- 6% on the portion exceeding €3,000
The success fee applies only to refunds effectively received by the client.
10. Travel Expenses
Where physical intervention is requested by the client, travel expenses may apply.
11. Right of Withdrawal
For consumers only, and in accordance with applicable consumer protection laws, the client benefits from a 14-day withdrawal period starting from the acceptance of the quotation.
12. Limitation of Liability
HSD Assist undertakes to perform services diligently and in good faith.
Liability shall be strictly limited to the amount invoiced for the relevant service.
13. Confidentiality & Data Protection
Personal data is collected solely for the purpose of providing the requested services and administrative follow-up.
Data is processed in accordance with applicable GDPR regulations.
14. Intellectual Property
All documents, summaries, templates, calculations, guides, and support materials prepared by HSD Assist remain the intellectual property of HSD Assist unless otherwise agreed.
